Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MyInspector mobile application and related services (the “Services”) provided by MyInspector (“we,” “us,” or “our”). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least the age of majority in your jurisdiction (or at least 13 with verifiable parental consent where required) to use the Services. If you use the Services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of unauthorized use.
3. License and acceptable use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business or professional purposes in accordance with these Terms.
You agree not to: (a) reverse engineer, decompile, or attempt to extract source code except where prohibited by law; (b) use the Services to violate law or third-party rights; (c) interfere with or disrupt the Services or servers; (d) upload malware or harmful content; (e) scrape or automate access in a way that overloads or circumvents intended use; (f) misrepresent your identity or affiliation.
4. User content
You retain ownership of content you submit (“User Content”). You grant us a worldwide license to host, process, transmit, display, and create derivative works (such as formatted reports) as reasonably necessary to provide and improve the Services and as described in our Privacy Policy.
You represent that you have the rights needed to submit User Content and that it does not violate law or third-party rights.
5. Subscriptions and fees
If the Services or portions thereof are offered on a paid basis, fees, billing cycles, and renewal terms will be presented at purchase or in a separate agreement. Taxes may apply. Failure to pay may result in suspension or termination of access.
6. Third-party services
The Services may integrate with third-party platforms (e.g., authentication, maps, cloud infrastructure). Your use of those services may be subject to separate terms. We are not responsible for third-party services.
7. Intellectual property
The Services, including software, design, trademarks, and documentation, are owned by us or our licensors. Except for the limited license above, no rights are granted.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Inspection and compliance decisions remain your professional responsibility. The Services are tools to assist workflows and do not replace professional judgment, codes, or legal requirements applicable to your work.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), IF YOU HAVE NOT PAID US.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
10. Indemnity
You will defend, indemnify, and hold harmless MyInspector and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Services, or your violation of these Terms or law.
11. Termination
We may suspend or terminate access to the Services at any time for violation of these Terms, risk to security, or legal requirements. You may stop using the Services at any time. Provisions that by nature should survive (including intellectual property, disclaimers, limitations, indemnity) will survive termination.
12. Changes
We may modify the Services or these Terms. We will post updated Terms with a new effective date. Material changes may be communicated through the app or email where appropriate. Continued use after changes constitutes acceptance where permitted by law.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which MyInspector is established, without regard to conflict-of-law principles, except where mandatory consumer protections in your country apply.
14. Apple App Store (if applicable)
If you obtained the app through the Apple App Store, you acknowledge that these Terms are between you and MyInspector, not Apple. Apple is not responsible for the Services or their content. Apple has no obligation to provide support for the app. In the event of failure to conform to a valid warranty, you may notify Apple and Apple may refund the purchase price where applicable; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms solely regarding your license of the app from the App Store.
